Roi Et Provincial Public Prosecutor The investigating officers for this case submitted it the Roi Et Provincial Police, Region 4 Police and the committee on lèse majesté cases at the Royal Thai Police Headquarters for consideration. The first meeting of the committee issued a prosecution order. But the Police Commissioner ordered further investigation of the behaviour of the accused and news sources. After further investigation, the committee issued an order not to prosecute for the consideration of the Police Commissioner. The case was then returned to Roi Et Police but the Roi Et Provincial Public Prosecutor issued a prosecution order.

Mr.Uthai S, aged 38, completed Grade 6 (Primary Education) and lives in a village in Thawat Buri District. He is a farmer and takes jobs around the village such as hairdressing and motorcycle repair. He has his own small rice mill which mills rice in the village. He is married with a 14-year-old son.

On 26 September 2009, the defendant was accused of giving the leaflets with a content  that defame the Queen and the Heir to other people .The defendant deny the accusation during the inquiry.

Circumstance of Arrest

The Police from Chiang Kwan police station and  Tha Wat Buri  police station came to the defendant 's house. The police notified the charge and asked for the confession.

22 November 2012 At Roi-et provincial court Room number 14, the court read the verdict. The court saw that the defendant was guilty by giving the leaflet to his neighbor and sentenced to three years in prison. But due to the fact that there are many political movements from several groups at that time, the defendant could receive information from various ways. The police committee considering lèse majesté cases saw the defendant had committed with reckless disregard for the truth. The court also saw that the defendant has good behavior and loyalty. Searching the defendant’s house found only one leaflet and there is no evidence that the defendant produced such leaflet, the court saw it appropriate to give the defendant and opportunity to be a good citizen. Therefore suspended the sentence for two years and ordered him to report to probation officials 4 times and to perform community service for 18 hours within a year.
