On 5 October 2014, Sulak Sivaraksa, a senior independent scholar participated in an academic discussion titled "Thai History: Construction and. Deconstruction" hosted by a student activist group in Thammasat University. During the event, Sulak mentioned about history in the era of King Naresuan and said that the famous elephant battle might not exist. Later, military officials including Lt.Gen. Phadung Niwetwan and Lt.Gen.Pittaya Wimalin reported Lese Majeste allegation against Sulak to the police at Chana Songkhram Police Station.
 
In October 2017, the police filed a case against Sulak to the military prosecutor at the Bangkok Military Court. The military prosecutor issued a non prosecution order on 17 January 2018 on the ground that evidence was not enought to proceed the case.
